Federal Drug Crimes

Federal drug charges are very similar to Wisconsin state drug charges. Federal drug laws prohibit the possession of a controlled substance, as well as its use, possession with intent to deliver it or sell it, delivering drugs or selling drugs, and trafficking drugs, including across state lines.

Federal drug penalties

The penalties provided under federal law for drug convictions also are similar to Wisconsin drug penalties, but are usually for longer prison terms. If convicted of a drug crime under federal law, and sentenced to prison, the prison term must be served in a federal prison rather than a Wisconsin state prison.

Federal and Wisconsin State Charges

A person can be charged for a drug crime by either or both a federal governmental unit and a Wisconsin state governmental unit. A single crime can involve both federal and state charges, and double jeopardy would not apply because the federal and state governments are considered separate (sovereign).

Federally prosecuted cases are heard in a federal court. The federal courts in Wisconsin are located in Madison, Milwaukee, Green Bay and Eau Claire.

Sentences when convicted by feds and state

Sentences can be ordered to run concurrent, but seldom is that the case. In most instances, if a person is convicted by both governments, the sentences will be served consecutively - one right after the other.

Drug crimes can be charged as either a misdemeanor or a felony offense, depending on the quantity and type of drug. The more addictive and dangerous the drug, the more severe the penalty. The greater the quantity, the more severe the penalty.
