murder
Murder is a broader term defining the illegal killing of another person under Wisconsin laws. By its definition, murder occurs during the commission of another felony, and is properly termed Felony Murder. Conversely, homicide can occur in several manners.
Homicide
A homicide is an unnatural death of another person. Homicide includes vehicular homicide, negligent homicide, homicide by use of a deadly weapon, homicide by use of a motorized vehicle, homicide by use of a motorized vehicle while intoxicated, and premeditated and intentional murder. Homicide also includes self defense that lacks true acts of self defense, sometimes called an imperfect self defense. Heat of passion crimes, which are known as crimes of provocation, are also illegal.
mitigated charges
In some cases, certain homicides can be mitigated to a lesser charged, excused or justified. If excused or justified, the crime can be dismissed. If mitigated to a lesser offense, such as if a homicide occurs as a result of provocation or coercion, then a first degree intentional homicide charge can be mitigated to a lesser second degree intentional homicide charge.
